Terms of Service

BIN Optimizer is a payment cost analysis and routing platform operated by BIN Optimizer Ltd (“we”, “our”, or “us”). The platform provides BIN-level interchange cost analysis, least-cost routing recommendations, and merchant rate benchmarking for acquirers, payment service providers, and processors (“Clients”).

By accessing or using the platform, you agree to be bound by these Terms of Service (“Terms”). If you are accepting on behalf of a legal entity, you represent that you have authority to bind that entity.

The platform provides the following core services:

• Real-time BIN lookup and card attribute resolution against a database of 1.4M+ BINs
• Interchange and scheme fee calculation based on card attributes, merchant category, and transaction type
• Least-cost routing recommendations returned via REST API, typically in under 40ms
• Merchant rate configuration and margin analysis
• Batch BIN analysis across a merchant portfolio

We reserve the right to modify, suspend, or discontinue any part of the service with reasonable prior notice.

Access to the API requires a valid API key issued by BIN Optimizer. API keys are associated with a specific Client and environment (live or test). Keys must be kept confidential; you are responsible for all activity under your key.

Fair use limits apply to all plans. The default rate limit is 100 requests per minute per API key with a burst allowance of 20 requests. Exceeding this limit will result in a 429 response. Sustained abuse may result in key suspension.

You must not use the API to:

• Probe, scan, or test the security of the platform without prior written authorization
• Resell or sublicense API access to third parties
• Circumvent rate limits or access controls by using multiple keys
• Reverse engineer the routing algorithm or BIN resolution logic
• Transmit full primary account numbers (PANs) or sensitive cardholder data through the API

Your data: You retain full ownership of your merchant configuration data, transaction data, and any data you upload to the platform. We process your data solely to deliver the service described in these Terms. We do not use your data to train or improve models for the benefit of other Clients without your explicit consent.

Our data: The BIN database, interchange rate tables, routing models, and platform software remain the intellectual property of BIN Optimizer. You may not extract, copy, or redistribute this data outside of normal API usage.

Aggregated insights: We may use anonymized, aggregated usage data (e.g., distribution of card types, aggregate approval rates) to improve the platform. This data cannot be attributed to any individual Client.

Interchange rates and scheme fees presented by the platform are based on published schedule data from card schemes (Visa, Mastercard, American Express, and others). These rates are provided for informational and analytical purposes only. They are subject to change without notice by the relevant scheme.

BIN Optimizer makes no warranty that the rates displayed are current, complete, or applicable to any specific transaction. Actual interchange costs are determined by the relevant card scheme at the time of settlement and may differ from estimates provided by the platform. You must not rely on platform output as a substitute for your own scheme membership agreements or settlement data.

You agree not to:

• Use the platform for any unlawful purpose or in violation of any applicable regulation
• Attempt to gain unauthorized access to the platform or its infrastructure
• Introduce malicious code, scripts, or bots
• Use the platform to process transactions on behalf of merchants in prohibited industries as defined in our Acceptable Use Policy
• Misrepresent your identity or the nature of your business when registering for an account

We reserve the right to suspend or terminate accounts that violate these Terms, without liability, and to report serious violations to relevant authorities.

We target 99.5% uptime for the API, measured monthly. Planned maintenance windows will be communicated with at least 48 hours’ notice. We are not liable for downtime caused by third-party infrastructure failures, force majeure events, or Client-side issues.

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, or consequential loss, including but not limited to lost profits, lost revenue, or lost data, even if we have been advised of the possibility of such loss.
• Our aggregate liability to you for any claim arising under these Terms shall not exceed the total fees paid by you to us in the 12 months preceding the claim.
• We are not liable for any routing decisions made by your systems in reliance on platform output, or for any settlement disputes arising from such decisions.

You agree to indemnify and hold harmless BIN Optimizer and its officers, directors, and employees from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms, your use of the platform, or your violation of any third-party rights.

Each party agrees to keep the other’s confidential information (including pricing, API credentials, and technical documentation) in confidence and not to disclose it to third parties without prior written consent, except where required by law or regulatory authority.

We may update these Terms from time to time. We will notify registered users by email at least 30 days before material changes take effect. Continued use of the platform after that date constitutes acceptance of the updated Terms.

These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Before commencing formal proceedings, the parties agree to attempt to resolve any dispute through good-faith negotiation for a period of 30 days.
